EYE ON LOUISIANA (KLFY) – What are the laws regarding CBD products in the State of Louisiana?
CBD is a compound of marijuana and therefore is considered a narcotic, making it illegal in the state.
“If you possess CBD oil, you really are in violation of the Federal Law,” said State Senator Fred Mills.
He discussed with Lester Duhe’, the laws regarding Cannabidiol Oil across Louisiana.
“Right now it is not legal in Louisiana, it’s not legal to sell it, it’s not legal to possess it.
It’s still considered a Schedule 1 Drug, and there are severe penalties to it,” said Mills.
CBD oil is extracted from either hemp or marijuana, and by default is considered marijuana under state and federal law according to the Louisiana Board of Pharmacy.
“If you feel compelled to use it, just buyer beware, you’re not sure what you’re getting,” said Mills.
“We had the gummies, the lotions,” said John Downs, the owner of Swamp Vapor.
He used to sell the CBD products at his various stores until about a month ago, when he received a cease and desist letter from the Office of Alcohol and Tobacco Control saying…
“The Farm Act approved the sale of CBD products, but Louisiana law stated that it doesn’t have a separation of anything to do with a marijuana plant,” said Downs.
He immediately removed the product from his stores.
“The only people that got the notice, were people that were ATC registered,” said Downs.
That’s the reason why you may still see the products in certain stores.
Which Senator Mills says is still illegal and you never know where the products are coming from,
“It’s the wild wild west, you don’t know what you getting,” he said.
In an advisory by the ATC earlier this month, it said agents will be issuing citation to any retail permit holders who offer the CBD products from sale, and will require that they be moved from the licensed premises.
All of the regulatory venues for the medical marijuana program has been accomplished according to Senator Mills.
However, researchers are still in the growing process.
Bills regarding hemp are currently being discussed this Legislative Session.
