Is THC Legal?
According to the annual Farm Bill in December last year, the federal government legalized hemp with a maximum of 0.3% THC per unit product. THC is the psychoactive substance found in marijuana plants that is responsible for causing the ‘high’ that people get after smoking a joint or having weed.
It often tends to produce hallucinations and trigger seizures in people with mental health disorders. THC in high potency can cause much damage to users if not controlled and consumed properly.
After the Farm Bill removed hemp from the list of controlled substances, companies started creating and selling an array of CBD products. CBD is a widely popular compound that is non-psychoactive and has anti-inflammatory properties. Contrary to THC, CBD is claimed to be soothing and produces calming effects.
CBD is used to reduce stress, anxiety, insomnia, depression, seizures in epilepsy, acute and chronic pain, inflammation, and even treat severe ailments like cancer and Alzheimer’s. Research supports that CBD is a substantial compound that can help alleviate the symptoms of a variety of diseases, however, there’s a lot to discover.
The only cannabis-based product approved by the FDA is Epidiolex, an oral solution, used to reduce seizures and other symptoms in two rare and severe forms of epilepsy.
While the market is flooded with CBD products, the government has strictly limited the concentration of THC per product which is 0.3%. If a product contains THC more than 0.3% per unit, it will be considered as illegal and might result in a positive drug test.
Recently, the US Food and Drug Administration issued warning letters to 15 companies for selling CBD products that are not properly tested, authorized or have different contents than labeled. The agency has not permitted CBD infused food yet, let alone highly potent THC containing products.
The FDA is in the process of identifying companies and products that are marketed with high medical claims of CBD and sold to consumers without proper testing. It will create regulatory guidelines that will structure the legality of CBD products, but till then brands need to be careful about how they create and sell their cannabis-based products.
The agency wants consumers to be aware of and educated about CBD. Consumers should know that not every CBD oil in the market will render relieving effects as it might not be certified, tested or authorized. It really depends on which brand you are choosing and their product concentration.
